The Texas Commission on Environmental Quality (TCEQ) has renewed the Construction General Permit (TXR 150000) effective March 5, 2008. This is the permit that construction activities greater than one acre operate under.
Construction activities that began before March 5, 2008 and submitted a Notice of Intent (NOI) to discharge under the previous General Permit must submit a new NOI to TCEQ and gain coverage under the renewed General Permit prior to June 3, 2008. This mainly applies to construction activities greater than 5 acres that will extend past June 3. The full application fee will be required. After March 5, 2008, construction activities greater than 5 acres that submit an NOI will automatically be covered under the renewed General Permit.
The renewed Construction General Permit has some minor changes from the previous version. Some items that changed are listed below:
Definition of Operator to include Primary and Secondary Operators
Fees and effective dates of coverage after the NOI has been submitted
Sediment basin calculations must be included in the Storm Water Pollution Prevention Plan (SWP3)
Concrete Batch Plant sampling and Best Management Practice implementation
Concrete truck wash-out requirements
Construction Site Notices modified
